HON. DARRELL DEXTER « » : Madam Speaker, I am about to read a notice of motion with respect to the life of Graham Dennis, and I wonder if the House would indulge us with a moment of silence at the end to commemorate the life of this outstanding Nova Scotian.

Madam Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas Graham Dennis, publisher of the Halifax Herald, holds the longest record of service as a publisher in the Canadian daily newspaper industry; and

Whereas The ChronicleHerald newspaper, under his direction, remained independent, a rarity in Canadian journalism; and

Whereas Mr. Dennis, an outstanding businessman and champion for this province, passed away last evening, leaving behind an important legacy of good, responsible journalism;

Therefore be it resolved that members of the House recognize what a great man Graham Dennis was, and send our deepest condolences to the Dennis family and the entire staff of The Halifax ChronicleHerald.

Whereas tomorrow, December 3^rd, marks the United Nations International Day of Persons with Disabilities, a day that highlights disability issues and encourages support for the dignity, rights, and well-being of persons with disabilities; and

Whereas approximately 10 per cent of the world's population, and one in five Nova Scotians, lives with a disability, and people are often unaware of the challenges persons face with disabilities; and

Whereas this year's theme, "Together for a better world for all: including persons with disabilities in development," has been designed to show us the benefits that can be realized from including persons with disabilities in all aspects of life;

Therefore be it resolved that all members of this House recognize the importance of December 3^rd as the International Day of Persons with Disabilities and take this opportunity to celebrate the contributions persons with disabilities make in communities across our province.

Whereas on December 1, 2011, Nova Scotians lost a great businessman and a true gentleman who possessed a real vision and undeniable spirit with the passing of Mr. Graham Dennis; and

Whereas Mr. Dennis' strength, spirit, and vision ensured that The ChronicleHerald remained grounded in the roots that his father and grandfather began, an independent, locally-owned newspaper addressing issues important to the province he so loved: Nova Scotia; and

Whereas his love and pride in Nova Scotia was shared with so many through his support for cancer research, the Dennis Pediatric Fund at the IWK - established for his late son, William - sheltered workshops, group homes, and the Coady Institute, to name just a few;

Therefore be it resolved that all members of the House extend our deepest sympathies to his wife, Gay, and Sarah, Heather, and the entire Dennis family, as well as the staff of The ChronicleHerald, for the loss of a father, grandfather, boss, and friend, and honour his memory by appreciating and protecting the potential that lies within Nova Scotia.

Whereas Graham W. Dennis passed away on December 1^st after a brief illness; and

Whereas after the death of his father, Mr. Dennis became publisher of The ChronicleHerald at the age of 26, a post that he held for more than 57 years; and

Whereas Mr. Dennis was instrumental in chronicling every major Nova Scotia story for over five decades, setting a standard for journalistic excellence, good corporate citizenship, and community involvement;

Therefore be it resolved that all members of this House of Assembly extend sincere condolences to the family and friends of Graham Dennis and salute Mr. Dennis' many contributions to Nova Scotia.

Whereas Jane Warren, a resident of Wolfville, received the Council of Canadians with Disabilities Award at the Nova Scotia League for Equal Opportunities AGM on Tuesday, July 12, 2011; and

Whereas Jane, living with a brain injury for almost 30 years, has been an outstanding advocate for people with disabilities and for people living in poverty; and

Whereas Jane Warren provides an excellent example of compassion and caring for others in her community;

Whereas Geoff and Jennifer Bishop put Round Hill, Annapolis County, Nova Scotia on the map when they were named Canada's 2011 Outstanding Young Farmers at a ceremony in Brandon, Manitoba on November 18, 2011; and

Whereas Geoff and Jennifer are the third generation to operate Bishop Farms Ltd. following the footsteps of Geoff's parents Andrew and Pam Bishop, and his grandparents Pat and Bill Bishop who purchased the farm in 1969 on immigrating from England; and

Whereas this young couple was chosen to receive this prestigious award based on their extensive community involvement, their innovative management practices and their commitments to being good stewards of the land;

Therefore be it resolved that the members of the House of Assembly join me in congratulating Geoff and Jennifer on being recognized for all their hard work and determinations and wish them and their four children Luke, Emma, Matthew and Ryan, future success as industry leaders.

MR. KEITH BAIN « » : Madam Speaker, I hereby give notice that on a future day I shall move the adoption of the following resolution:

Whereas the Nova Scotia Ground Search and Rescue Associations represents 24 teams across Nova Scotia who, like volunteer firefighters, can be called out at anytime, 24 hours a day seven days a week; and

Whereas Nova Scotia Ground Search and Rescue Teams are 100 per cent volunteer and operate under the authority of Nova Scotia's Emergency Management Office and in turn can be called out for lost persons incidents by the RCMP, municipal police forces across Nova Scotia, and Parks Canada; and

Whereas despite the excellent service provided by the teams of the provincial association, they are somehow not classified as emergency services providers;

Therefore be it resolved that the minister responsible for Nova Scotia Emergency Measures Organization recognize the work and time committed by these volunteers and make the necessary changes so that all Ground Search and Rescue organizations across Nova Scotia will be recognized as emergency services providers.

Whereas Shelburne businessman Nick Stewart was named Entrepreneur of the Year at the Shelburne County Business Development Corporation and Shelburne and Area Chamber of Commerce 2011 Business Excellence Awards on October 20, 2011; and

Whereas Nick Stewart has grown his business - Nick Stewart Concrete Work - through good customer service, quality workmanship, a willingness to take risks and a desire for continuous learning; and

Whereas Nick Stewart is respected by his customers and his staff, and can often be seen taking an active role in the community at local agricultural events;

Whereas the Pictou County Chamber of Commerce held its first Best of Pictou County People's Choice Awards, with 800 nominations in 25 categories; and

Whereas the contest for Best of Pictou County People's Choice Award voting was done on-line, and over 1,000 votes were received; and

Whereas this year's winner for Best Garden Centre was won by West River Greenhouses, which is located in Durham and New Glasgow and is owned and operated by Robert and Colleen Parker;

Whereas Laura Fitzpatrick is a fourth-year biology and chemistry student, an accomplished musician and varsity athlete, who has received the Presidential Scholarship and the Lieutenant Governor's Medal and has received two NSERC research grants and researched anti-cancer fungi in China; and

Whereas Laura has extensive experience volunteering at local hospitals and is the founder of the Saint Mary's University Habitat for Humanity Society, organizing builds in New York and Mississippi; and

Whereas Laura travelled to Northern Ireland in February to facilitate conflict resolution workshops in Belfast, and has co-authored a peace education play;

Therefore be it resolved that the members of this House of Assembly congratulate Laura Fitzpatrick on her extensive achievements, and on being named the 2011 Young Woman of Distinction by the Canadian Progress Club, Halifax Cornwallis, and wish her well in her future endeavours.

Whereas Joseph Marshall from Eskasoni was recently invested into the Order of Nova Scotia; and

Whereas Joseph Marshall, a veteran, leader, role model, and mentor, has dedicated his life to advocating for the rights of the Mi'kmaq people; and

Whereas Mr. Marshall is the executive director and founding member of the Union of Nova Scotia Indians, a tribal council which was created in 1969 to provide a unified voice for the Mi'kmaq people in Nova Scotia;

Therefore be it resolved that all members of this House of Assembly congratulate Joseph Marshall for his investment into the Order of Nova Scotia and thank him for his many contributions to our province.

Whereas Eastern Passage resident Betty Ellwanger has been involved with volunteer committee work through the Lions Club over the past 15 years; and

Whereas in the Spring of 2011, Betty received her 15-year Monarch Certificate of Service from the Eastern Passage-Cow Bay Lions Club at the 39^th Charter Night; and

Whereas the extent of Betty's volunteerism includes being an active committee member for such events as the Saturday breakfast, merchandise bingos, carnival, and the New Year's Eve dance;

Whereas the mission of Yarmouth Life Skills for Disabled Adults is to provide a broad range of programs and services which reflect the diverse needs of clients through on- and off-site activities which promote inclusion, independence, and choice; and

Whereas Sherry Robertson has gone above and beyond as Executive Director of Yarmouth Life Skills by working tirelessly with and for the clients she serves and by being a constant example of the Yarmouth Life Skills motto of helping people with disabilities live and work with dignity; and

Whereas Sherry Robertson recently received the Lieutenant Governor's Person with Disabilities Employer Partnership Award, which recognizes Sherry Robertson and Yarmouth Life Skills for Disabled Adults as a role model for business excellence in hiring, accommodating, and serving persons with disabilities;

Therefore be it resolved that the members of this House of Assembly congratulate Sherry Robertson and Yarmouth Life Skills for Disabled Adults on receiving the Lieutenant Governor's Person with Disabilities Employer Partnership Award and thank Sherry Robertson and her organization and staff for making such a positive contribution to our community.

Attendu que le 15 juin, 2011, l'Université Sainte-Anne à leurs remise des certificats et des diplôme a décerné un doctorat honorifique à Vaughne Madden pour son travail dans les services communautaires; et

Attendu que Vaughne, qui et présentement directrice général a l'office des affaires acadiennes, et graduée en 1988 avec un diplôme en services sociaux et toute sa carrière elle s'est consacrée au développement et à la promotion de la culture et le patrimoine; et

Attendu que les forces de Vaughne sont dans le partenariat et le recrutement de personnages clés pour des projets de développement communautaire; qu'elle a contribué à la fondation et au succès de plusieurs organismes communautaires tells que le Congrès Mondial 2004 et le Conseil de développement économique de la Nouvelle-Écosse pour en nommer que deux;

Whereas on June 15, Université Sainte-Anne at their graduation exercises awarded an honorary degree to Vaughne Madden for her work in community services; and

Whereas Vaughne, who is presently the Director General at the Office of Acadian Affairs, graduated in 1988 with a degree in social services, and throughout her career has dedicated herself to the development and promotion of the culture and heritage of Acadians; and

Whereas Vaughne's strengths lie in the partnerships and the recruitment of key figures for community development projects and she has contributed to the birth of several individual agencies, such as the Congres Mondial 2004 and the Economic Development Council of Nova Scotia, just to name two.

Therefore be it resolved that all members of this House of Assembly congratulate Vaughne Madden on being awarded this honorary degree and wish her continued success in all her future endeavours.

Whereas the Royal Canadian Legion Branch 38 was established in Liverpool, Queens County, in 1931; and

Whereas the Legion's mission statement is to serve veterans, including serving military and RCMP members and their families, to promote remembrance, and to serve our communities and country; and

Whereas the Royal Canadian Legion Branch 38 celebrated its 80^th Anniversary under the Canadian Legion of the British Empire Service League Charter on July 13, 2011;

Therefore be it resolved that the House of Assembly recognize and congratulate the Royal Canadian Legion Branch 38 on 80 years of continued service to our veterans, serving military and RCMP, and community.

Whereas Ms. Jahn is a co-founder and steering committee member of the Nova Scotia Housing and Homelessness Network and the chair of the Salvation Army Community Advisory Board; and

Whereas Ms. Jahn also serves on the Board of the Affordable Housing Association and the North End United Housing Co-op;

Whereas the group has managed to complete work on the Battery Point Lighthouse, restoring it from the ground up with new windows, a fresh coat of paint and a new roof, thanks to the contributions of materials and in-kind services donated by NSCC Lunenburg Campus, BMR Hardware in Lunenburg, Maughan's Construction and Walter Flower;

Therefore be it resolved that this House of Assembly recognize the community effort and spirit present in Lunenburg County to preserve this historic lighthouse for future generations.

Madam Speaker, it is my pleasure to begin debate on Bill No. 123, the Corrections Act. As all members of this House are aware, on October 30^th, the Nova Scotia Government & General Employees Union, Local 480 Correctional Officers ratified a new contract agreement with the province.

Madam Speaker, the changes we are proposing to the Corrections Act today are necessary to fulfill a key part of this agreement - moving correctional officers into the civil service. Bringing correctional officers into the civil service is important and has many benefits. It has administrative benefits, allowing government to negotiate one collective agreement. It also means that we will be better able to manage the ongoing challenges of operating a correctional facility; one of those challenges is staffing. When staff want to move on, or are no longer able to work in a correctional facility, they will have more options available to them as members of the civil service. As well, since this contract will also see the conversion of some part-time staff to full-time status, we will have more flexibility to ensure we are appropriately staffed, especially when responding to sick time and training requirements.

Madam Speaker, we are not here to talk about the details of the new contract agreement. The agreement was ratified by 88 per cent of the membership and is in the process of being implemented. Suffice it to say that this government believes having correctional officers join the civil service is a very good thing. We highly value the work correctional officers do every day in a very challenging environment. We are very pleased they have voted to join the civil service.

Madam Speaker, the amendments to the Act are really technical to help us move the contract agreement of the Nova Scotia Government Employees Union Local 480 forward. Currently the Corrections Act sets out that correctional officers are employees of the Department of Justice. One, we need to repeal this section of the Act to remove the provision which established correctional officers as Department of Justice employees; and, two, amend the section of the Correctional Services Act which references the Corrections Act. This will ensure that the legislation allows correctional officers to move from the Department of Justice into the civil service under the Civil Service Master Agreement.

HON. RAMONA JENNEX « » : Madam Speaker, I now move that Bill No. 124, an Act to Establish Arts Nova Scotia, be read a second time.

Madam Speaker, in February the province mapped out its approach to developing the arts and culture sector in Nova Scotia. The five-point plan announced by the Premier was based on extensive consultations with members of the sector in the Fall of 2010. Central to that plan was the creation of Arts Nova Scotia, an independent body to administer funding for individual artists and the cultural organizations that support them.

Madam Speaker, with this legislation we are fulfilling that commitment by establishing the framework for Arts Nova Scotia. We are also living up to our commitment to give the arts and culture sector a voice in determining the province's priorities for growing our creative economy. A four-member transition committee, chaired by the member for Lunenburg and including three members from the arts and culture community, was asked to develop a terms of reference and criteria for appointing members to Arts Nova Scotia.

Madam Speaker, their report was released the other day and formed the basis for the legislation being introduced. Once this bill is passed, an interim board for Arts Nova Scotia will be appointed next year, and the process of transitioning the grant programs outlined in the transition committee's report will begin. When it is up and functioning, Arts Nova Scotia will be responsible for $2.4 million in grant funding that goes directly to artists to support their creative pursuits and professional development.

Madam Speaker, arts and culture promote vibrant communities that benefit from the creativity and innovation of our artists and creators. With the creation of Arts Nova Scotia, the province is placing the decisions related to funding for artists into the hands of those best placed to make those decisions, the artists themselves.

And with that, Madam Speaker, I take my place.

MR. HAROLD THERAULT: Madam Speaker, I'm pleased to stand and speak a little bit on Bill No. 124. We fully support this bill and we're looking forward to it to go to Law Amendments Committee and, hopefully, be proclaimed as quickly as possible.

I know it's a good bill, it's good for our culture in Nova Scotia, and it's good for arts in Nova Scotia, period - it's going to be interesting to see what the Third Party is saying, after they cut this bill 10 years ago.

So, with that, I'll take my seat, Madam Speaker. (Laughter)

MR. KEITH BAIN « » : Thank you, Madam Speaker, and I thank the member for Digby-Annapolis for mentioning us during debate on this bill.

Madam Speaker, the PC caucus is, indeed, in favour of this bill, but we also think the good part of the bill, and something that we have to watch, is that it is a merit-based grant program.

The only concern we might have is there's nothing in the bill saying what the salary of the executive director would be, where that money might be coming from. I know the administration does come from the department itself, but the executive director is a separate entity, and whether or not that will affect the grant program, but we look forward to seeing the bill go to Law Amendments Committee for further discussion.

MADAM SPEAKER « » : The honourable member for Lunenburg.

MS. PAM BIRDSALL « » : Madam Speaker, I am very happy to be able to stand today and talk about this bill. The arm's-length arts council has been something that our community has wanted for a very long time, and it has to be noted that in March 2002 the arts council was dissolved. That was a council that took almost two decades to be formed, and with all the members of the arts community of Nova Scotia working very hard to have that happen.

The Nova Scotia Arts Council at that time existed for only six years before it was dissolved, and at that time it was to the great surprise of the people in the arts community - not only in the province but in the country. At the time there were massive demonstrations right across the province and, in front of Province House, our then Leader of the Opposition, our current Premier, said to the crowd how wrong-headed he felt this whole decision was. He said we are only one election day away from the reinstatement of the arts council and, in fact, that is just what we've done. In fact, that is just what we've done. Our government, in two and a half years, has reinstated the arts council by bringing forward this policy.

I have to say that as ministerial assistant for Communities, Culture and Heritage, I was honoured to be the chair of this transition committee that drafted the terms of reference for the legislation for this committee. I have three wonderful people who worked with me on this committee.

We have Leah Hamilton, who is experienced as an art consultant and helped focus development in this area, and who has been absolutely tremendous. Leah is a consultant for Genesis Consulting of Halifax, a firm that specializes in projects in the arts field. Ms. Hamilton's work has including planning and organizational development in the arts and culture, heritage, and tourism fields. She was a member of the former provincial arts council from 1999 to 2002. Her involvement in the arts and culture sector has included serving as treasurer for the Eastern Front Theatre, a past member of the executive for Theatre Nova Scotia, and currently as a member of the Nova Scotia Masterworks Awards Foundation.

We have Paul Caskey, who is the artistic director of Live Art Dance Productions and has a long history of involvement in Canada's professional dance community. He's been a dancer, choreographer, lighting designer, and artistic director in a career that has spanned the country. Mr. Caskey has created original dance productions and served as co-artistic director for Studio 303.

Christopher Shore is executive director of Theatre Nova Scotia. His career has spanned radio, stage, film, and television. A successful actor, he has appeared onstage with Neptune Theatre, Tarragon Theatre, the National Arts Centre, and Eastern Front Theatre, and in the films Sea Wolf, October 1970, and Shattered City: The Halifax Explosion. Mr. Shore has written for the stage, radio programs, and children's animated television series. His play, Liar, won a best new play award in 2001 at the Robert Merritt Awards.

These three people worked tirelessly. We first met at the end of June and then met for seven all-day meetings. I have to say that the level of integrity and the quality of experience that was brought to this committee by these people were stellar. Madam Speaker, hard work went into this to make sure that this would be a report that the arts community could accept and feel that it came from the people themselves and not as a directive from government. We were asked to do a specific task and there was a timeline attached to it. We had hoped to do it this Fall, and there were moments where we thought it was miraculous that we actually got it done to that point and on time.

Some of the things that were asked of the transition team: we were asked to develop the terms of reference, with that intending the purpose and general functioning of Arts Nova Scotia and the recommended level of authority and areas of responsibility with regard to programs offered by Arts Nova Scotia, and their expectations as to Arts Nova Scotia's operation and accountability. So we sat and talked and workshopped words and came up with what we felt were the appropriate mission statement, vision mandate, and values. We did that by talking to other arts councils across the country. Extensive conversations went on. We did on-line research, looking at what other art councils in the world look like, especially in Scotland and England and places that have similar arts communities.

The mission statement we developed is: "Arts Nova Scotia exists to advance the arts by investing in creativity, fostering innovation and promoting the value of the arts." Even though that's one sentence, it took about a day to workshop.

The mandate is: "To encourage creative expression by funding activities in the arts," and of course the main role of the arts council will be to fund individuals and groups. "Funding will be made available through programs that invest in artists and arts organizations; specifically:

• Grants that promote and support artist creation and innovation
• Grants that support presentation and producing activities, including operational support to producing and presenting organizations
• Grants that support professional development of artists and workers in the arts."

We feel that helping to support the development of artists is another really, really important thing. This is to mature our young artists who are coming along with the help of the arts council. Grants will be merit-based and art prizes, awards, and artwork acquisitions will all be part of this.

One of the other parts of our mandate is to invest in the creativity of all artistic disciplines; to employ peer assessment processes - and with this went into great detail figuring out the matrix of the people who would be on the board and how they would actually follow through with their job; to communicate the cultural, social, and economic importance of the arts to the community at large; to advise and work with the Minister of Communities, Culture and Heritage, provincial Culture staff, and advisory bodies in the arts; and to initiate and oversee arts-related research.

Madam Speaker, once this bill is passed, an interim board for Arts Nova Scotia will be appointed. Our attention that was put to the appointment of that board took considerable time. We created a matrix that looked at all the diversity that we could. We looked at age; we looked at cultural diversity; we looked at the various levels of work, whether it was a mature person who had been involved in their area for a long time, in the various geographical parts of the province. We wanted a board that would represent Nova Scotian artists well. (Interruption) Absolutely, inclusion. When it's up and functioning, Arts Nova Scotia will be responsible for $2.4 million in grant funding that goes directly to artists for their creative pursuits and development.

Madam Speaker, Arts Nova Scotia will set its own policies and guidelines and ensure that decisions regarding funding to artists and organizations that support their creativity and professional development are based on their artistic merit. Those decisions will be final and not subject to political process interference. The board will make their decisions and that will be that, once the board is appointed.

Madam Speaker, our goal in government is to ensure that funding to support the arts in Nova Scotia goes into the hands of those who will drive the growth for our economic economy, our creative economy. It is good for Nova Scotia families because it supports innovation and creativity in the communities across our province. The arts and culture promote vibrant communities that benefit the creativity and innovation of artists and creators. With the creation of Arts Nova Scotia, the province is planning the decision relating to funding for artists and putting it into the hands where it should be placed - the artists themselves. I will now take my seat.

MS. LENORE ZANN « » : Madam Speaker, today is a great day for arts and culture in Nova Scotia. I am really pleased that our NDP Government is introducing legislation in this House of Assembly to enable the establishment of a new provincial arts council named Arts Nova Scotia, and to formalize the structure and mandate of a new advisory council called the Creative Nova Scotia Leadership Council - both important commitments in our government's five-point arts plan, which was announced earlier this year, and something which I've been championing both within and without government ever since I came into office in June 2009.

In fact, as ministerial assistant to Tourism, Culture and Heritage for my first two years in government, I personally worked very hard to help convince many people that this was, in fact, the right thing to do and the right thing to do at this particular point in our province's history. So suffice it to say I'm extremely pleased by this announcement today as are many, many artists right across this province.

I believe that it shows our NDP Government is listening, Madam Speaker, and that we recognize the important role that arts and culture play in making Nova Scotia communities vibrant. After all, as I've always said, Nova Scotia is blessed with a natural resource that is clean, green, sustainable, and constantly renewable, and that is the talent and creativity of its people.

Legislation which we introduced December 1^st will establish Arts Nova Scotia and formalize the structure and the mandate of the Creative Nova Scotia Leadership Council. Now, I have to say that the previous Progressive Conservative Government was widely criticized by artists from across this province when in 2002, with Rodney MacDonald as Minister of Tourism, Culture and Heritage, the provincial arts council was disbanded despite strong criticism from the arts and culture community.

I was living in Vancouver at the time, and I heard the furor . . .

MADAM SPEAKER « » : Order, please. The chatter in the room is getting a little loud. The honourable member for Truro-Bible Hill has the floor.

MS. ZANN « » : Thank you, Madam Speaker. What a good Speaker you are. It's great to have a woman Speaker in the Chair.

I have to say that I was living in Vancouver at the time, doing film and television, and I heard the furor from the West Coast. Many of my friends wrote to me; many people were so upset about what was going on in Nova Scotia. Five years later I actually moved home and decided to run for office because I felt that we really need to get more artists involved in government and in making really important decisions that will affect all people right across the province. In fact, one of my friends is a successful artist - Alan Syliboy of Millbrook. He is a fantastic artist, doing very, very well. He was actually on the former arts council and he shared with me the sad story of the day the arts council was disbanded with no prior warning. They were all told to pack up their belongings and go home, after which the doors were locked.

Since the NDP has formed the government, we have been listening to the voices of the arts and culture sector. We believe that the sector itself is in the best position to make decisions about funding for individual artists, and Arts Nova Scotia will be able to do just that with the legislation that we are putting forward today.

On February 14^th we mapped out the government's approach to developing the arts and culture sector in Nova Scotia. The five-point plan that we announced was based on extensive consultations with members of this sector in the Fall of 2010. In May 2011, a transition committee of arts and culture sector members was established to develop the terms of reference and criteria for appointing members to Arts Nova Scotia. They submitted their support earlier this Fall and the report was made public yesterday. So I think it's very fair to say that our government is committed to improving life for all artists right across the province and that we've showed our commitment to improving government's relationships to the arts and culture sector by listening to their concerns and suggestions. We are acting on the priorities that were identified.

This will definitely help our creative economy grow. The province will continue to move forward with our five-point plan, and this will help shape a positive future for Nova Scotia and for Nova Scotia's numerous talented artists, so that finally they are getting the respect and the government support they deserve.

I think it's important to note that arts and culture contribute to strong communities by spurring creativity, innovation, jobs, and many, many economic spinoffs. This can't help but make life better for all families. After all, this is exactly what the creative economy is all about. Just as our film and television tax credit changes are showing, our film and TV community is growing. It is doing extremely well. People are so happy to be living here in Nova Scotia that many more people are actually moving here. I had five people contact me just in the last month, Madam Speaker, who are professional artists who are actually moving to Truro because they want to be part of the vibrant community that is growing there.

AN HON. MEMBER: A singer and dancer, right over here.

MS. ZANN « » : No, actually they're not singer/dancers. They are directors and film-makers, which is very exciting. In fact, in my own constituency of Truro-Bible Hill, my own regional development agency, CoRDA, is already working on a special study on the creative economy and its impact on Colchester County. So I'm very excited to have the opportunity to work with them on this, Madam Speaker, as soon as the House rises for Christmas.

Arts Nova Scotia will be responsible for $2.4 million in grants that go directly to the artists of Nova Scotia. The transition committee has proposed a model that will minimize operational expenses by having administrative and staff support continue to come from the Department of Communities, Culture and Heritage, from its existing budget envelope. This will ensure that Arts Nova Scotia is able to focus on its decision making, and that grant funding is not impacted by operational costs.

This will not compromise the independence of their decision-making ability, Madam Speaker. The key point here is that their decision making will be independent; having administrative support come from the department does not affect the independence of this decision making. That's very clearly laid out in the legislation. The board of Arts Nova Scotia will make its own policies and be responsible for final decisions related to the funding that it oversees. This was the recommendation from the transition committee and we've accepted that and make sure that it is reflected in the legislation.

The report also outlines that programs will be under the control of Arts Nova Scotia - they include grants to individuals; grants to organizations and small groups related to commissioning, production and presentation, and professional development; operating assistance to cultural organizations related to producers, Nova Scotia Art Bank Purchase Program, and the Portia White Prize.

The transition committee also outlined a set of criteria for the board of Arts Nova Scotia in its report to ensure a broad representation in terms of the sector, gender, geography, and age; they've also recommended a board, between nine and eleven members, and we are accepting that criteria. We'll follow the advice they've provided and seek input from the sector to appoint the initial board, and we expect that to happen, Madam Speaker, in the near future.

There needs to be more discussion about the Nova Scotia endowment of the arts before we decide what happens to that, but we will be carrying on that dialogue with the board of Arts Nova Scotia and with the Creative Nova Scotia Leadership Council, to ensure that the fund supports the development of the sector in the best possible way.

I believe this legislation provides the structure for a strong arts funding body and I look forward to seeing the Arts Nova Scotia board build on the foundation established today. Work has also begun on a cultural strategy by undertaking a review of literature related to the creative economy, and a subcommittee of sector members has been formed to advise government on the status of the artist legislation to reflect the importance of arts and culture to Nova Scotians. This is very exciting, Madam Speaker.

With the introduction of legislation for Arts Nova Scotia, the government has shown that the arts and culture sector is an intrinsic part of the fabric of this province, which is something that I've always said, Madam Speaker. It's not just the icing on the cake, it's actually the meat and potatoes, or the juice that holds it all together. These pieces of legislation help promote the development of the entire sector, and the status of the artist legislation is expected to be introduced around 2012.

I'm very pleased to have the opportunity to speak to this legislation today, Madam Speaker, and to say thank you personally to our department, to our minister, to my colleague, the member for Lunenburg, and also to our Premier for fulfilling his promise to the artists of Nova Scotia, when he stood on the steps of this Legislature and said "we are only one election day away from the reinstatement of the arts council."

Madam Speaker, I would like the House and all artists to note that this is a perfect example of our Premier acknowledging his word and following through on an important pledge to an important sector. I am very, very proud to be part of a government which acknowledges the importance of arts and culture in Nova Scotia, and acts upon the desires and wishes of our talented and much-deserving artists.

In conclusion, I'm also glad that as a lifelong professional artist myself, I could play even a small role in bringing this legislation to fruition, and I thank my constituents of Truro-Bible Hill for making sure that I was in a position to do so.

This is one of the main reasons why I ran for office, Madam Speaker, because I believe that all governments need more artists helping to solve the problems and issues of the day. We think outside the box, we work collaboratively, we support each other, and we are used to working on a shoestring budget and turning straw into gold. With that, I conclude my remarks.

HON. CHRISTOPHER D'ENTREMONT « » : Madam Speaker, I just want to quickly make a couple of comments. I want to thank the government for bringing this bill forward. I want to thank them for the work that they've done, that they did in consulting with the industry to make sure that this is the right move forward. What we did see - being a member of the previous government that seems to be villainized by the member for Digby-Annapolis, I had to say a couple of words about this - what we saw a number of years ago were organizations and a community that weren't working, dollars that were being used up by the bureaucracy, that were being used up and not getting to the artists. That's why at the time, the minister, then the Premier of the day, made the change to create at least something that would find the dollars making their way to the artists. Hey, evolution happens. Things will happen where new systems will be put in place and I hope that this bill, through the new arts council, will work. I hope that the dollars and cents will make their way to the artists who are creating the so important fabric of our communities.

Madam Speaker, I think it's very important that we have a vibrant and good arts community in Nova Scotia, and I do wish it well, but I can say that our caucus will be watching it closely to make sure that it is doing what it's supposed to be doing and that is making sure that it is creating a thriving arts community in Nova Scotia and not being used up by needless bureaucracy that ultimately will not help artists in Nova Scotia.

Madam Speaker, I thank you for the opportunity to speak to that but also I want to thank the member for Truro-Bible Hill. She took paper out of her work there, and I thought that was incredible to see that she was using a computer to read her information because I think we use far too much paper in this House of Assembly.

With the creation of the Creative Nova Scotia Leadership Council, government is underscoring its commitment to listen to voices of the arts and culture community as we develop priorities for supporting the sector.

Madam Speaker, under the leadership of its chair, Ron Bourgeois, the 15-member council has already begun to look at research that will help to move forward with its work on the creative economy and a cultural strategy for Nova Scotia.

Madam Speaker, the Creative Nova Scotia Leadership Council will play an important role as government proceeds with other elements of its five-point plan for the coming year. This includes status of the artist legislation to recognize the importance of arts and culture in Nova Scotia. Nova Scotians see the valuable contributions made by arts and culture to their communities every day. Artistic expression celebrates our diverse culture and contributes to the quality of life enjoyed by Nova Scotia families.

The province has listened to the voices of the arts and culture sector and is acting on the priorities identified by them to help our creative economy grow. Thank you, Madam Speaker, and with that I take my place.

Whereas the knowledge and precision shown by the corps is testament to their dedication and hard work during the year; and

Whereas the award for Top Drill Instructor was presented to WO Aaron Pearce of Debert, Colchester North;

Therefore be it resolved that all members of this House of Assembly congratulate WO Aaron Pearce for receiving this impressive award and commend his commitment to the cadet corps.
