Explanatory Notes

Clause 1 requires vendors or employers of vendors to require proof of age from purchasers of tobacco appearing to be under the age of 25 years.

Clause 2 prohibits the operation of new establishments that exclusively sell tobacco and tobacco products within three kilometres of a school.

Clause 3 prohibits the sale of electronic cigarettes and e-liquid except in an establishment that exclusively sells tobacco and tobacco products.

Clause 4 requires the Minister of Health and Wellness and the Minister of Education and Early Childhood Development to, by December 30, 2020,

(a) devise and implement educational campaigns for junior high school and high school students respecting electronic cigarettes and nicotine; and

(b) conduct research, including public consultations on raising the legal age to purchase tobacco products to 21 years of age.

An Act to Amend Chapter 14
of the Acts of 1993,
the Tobacco Access Act

Be it enacted by the Governor and Assembly as follows:

1 Subsection 5(4) of Chapter 14 of the Acts of 1993, the Tobacco Access Act, is amended by striking out "nineteen" in the third line and substituting "twenty-five".

2 Chapter 14 is further amended by adding immediately after Section 9AA the following Section:

    9AB (1) No vendor or employee of a vendor shall operate an establishment that exclusively sells tobacco and tobacco products within three kilometres of an elementary school, junior high school or high school.

    (2) Subsection (1) does not apply to an establishment that exclusively sells tobacco and tobacco products on the day this Section comes into force.

3 Chapter 14 is further amended by adding immediately after Section 9B the following Section:

    9C No person shall sell electronic cigarettes or e-liquid other than in an establishment that exclusively sells tobacco and tobacco products.

4 Chapter 14 is further amended by adding immediately after Section 12A the following Section:

    12B (1) The Minister and the Minister of Education and Early Childhood Development shall

    (a) jointly devise and implement educational campaigns for students in junior high schools and students in high schools respecting the health risks of electronic cigarettes and nicotine; and

    (b) conduct research, including public consultations, on raising the legal age to purchase tobacco products to twenty-one years of age.

    (2) The educational campaigns must be implemented and the public consultations must be concluded no later than December 30, 2020.
