Explanatory Note

This Bill allows public utilities to charge lesser amounts for services performed in respect of charitable housing.

An Act to Amend Chapter 380
of the Revised Statutes, 1989,
the Public Utilities Act,
Respecting Charitable Housing

Be it enacted by the Governor and Assembly as follows:

1 Chapter 380 of the Revised Statutes, 1989, the Public Utilities Act, is amended by adding immediately after Section 71 the following Section:

    71A (1) In this Section, “charitable housing” means housing operated by a prescribed charitable entity.

    (2) Notwithstanding Section 71, a public utility may charge, demand, collect or receive less compensation for any service performed by it than is prescribed in such schedules as are at the time in force if the service is performed in respect of charitable housing.

2 Section 118 of Chapter 380, as enacted by Chapter 41 of the Acts of 2012, is amended by adding immediately after clause (a) the following clause:

    (aa) prescribing charitable entities for the purpose of subsection 71A(1);
