Explanatory Note

This Bill requires the Minister of Agriculture to take steps to maintain the land link between Nova Scotia and New Brunswick and to spend at least $10 million per year on the maintenance in each of the next five fiscal years.

An Act to Amend Chapter 22
of the Acts of 2000,
the Agricultural Marshland Conservation Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Section 4 of Chapter 22 of the Acts of 2000, the Agricultural Marshland Conservation Act, is amended by adding immediately after subsection (2) the following subsections:

    (2A) The Minister shall take such measures as are necessary or advisable to maintain the land link between the Provinces of Nova Scotia and New Brunswick, which may include

    (a) commissioning engineering studies respecting threats to the continued existence of the land link; and

    (b) causing to be constructed any work or undertaking necessary to maintain the land link.

    (2B) In each of the fiscal years between 2018-19 and 2022-23, inclusive, the Minister shall spend no fewer than ten million dollars on the maintenance of the land link between the Provinces of Nova Scotia and New Brunswick.

(2) Subsection 4(3) of Chapter 22 is amended by striking out “and (2)” in the second and third lines and substituting “, (2), (2A) and (2B)”.

(3) Subsection 4(4) of Chapter 22 is amended by adding “or required” immediately after “authorized” in the second line.
