Explanatory Note

This Bill allows for incentive or bonus zoning in all areas of the Halifax Regional Municipality. Previously, incentive or bonus zoning was only permitted in the HRM by Design Downtown Plan Area and the Centre Plan Area.

An Act to Amend Chapter 39
of the Acts of 2008,
the Halifax Regional Municipality Charter,
Respecting Bonus Zoning

Be it enacted by the Governor and Assembly as follows:

1 Subsection 31A(1) of Chapter 39 of the Acts of 2008, the Halifax Regional Municipality Charter, is repealed.

2 Clause 209(a) of Chapter 39, as enacted by Chapter 18 of the Acts of 2013, is amended by striking out “in the Centre Plan Area” in the first and second lines.

3 Clause 235(5)(k) of Chapter 39 is repealed and the following clause substituted:

    (k) provide for incentive or bonus zoning;

4 Subsection 245A(1) of Chapter 39, as enacted by Chapter 41 of the Acts of 2008 and amended by Chapter 16 of the Acts of 2009 and Chapter 18 of the Acts of 2013, is further amended by striking out “respecting the HRM by Design Downtown Plan Area and the Centre Plan Area” in the last line.
