An Act to Promote
the Use of Donkin Mine Coal
by Nova Scotia Power Incorporated

WHEREAS the Donkin coal mine can provide employment to Nova Scotians;

AND WHEREAS the Donkin coal mine can provide a steady source of fuel for Nova Scotia Power Incorporated;

AND WHEREAS Nova Scotians would benefit from stable power rates;

AND WHEREAS a four-year period of coal mining would provide information on which the economic viability of the Donkin coal mine can be determined;

THEREFORE be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Donkin Coal Mine Act.

2 "Donkin mine coal" means coal extracted from the Donkin mine located off the shoreline of Donkin, Cape Breton, within the Donkin Resource Block.

3 Nova Scotia Power Incorporated may use Donkin mine coal to produce electricity for a period not to exceed the four years of the exploratory stage.

4 (1) Nova Scotia Power Incorporated is exempt from the provincial emission cap for any sulphur dioxide, nitrogen oxide or mercury emissions resulting from its use of Donkin mine coal for a period not to exceed the four years of the exploratory stage.

(2) Nova Scotia Power Incorporated is exempt from its emission allocations pursuant to the Environment Act for any emissions resulting from its use of Donkin mine coal for a period not to exceed the four years of the exploratory stage.

5 In the event of a conflict between this Act and any other enactment, this Act prevails.
