An Act to Prevent the Contamination
of Drinking Water
1 This Act may be cited as the Prevention of Drinking Water Contamination Act.
"inspector" means an inspector appointed under the Environment Act and includes any municipal or town police officer and any member of the Royal Canadian Mounted Police;
"PFAS" means perfluoroalkyl and polyfluoroalkyl substances.
3 (1) No person shall engage in any activity that releases, or may release, waste containing PFAS into any water supply or waterway.
(2) No person who owns or controls waste containing PFAS shall permit that waste to be released into any water supply or waterway.
4 (1) A person who violates Section 3 is guilty of an offence.
(2) A person who commits an offence under this Act is liable on summary conviction to a fine of not less than $1,000 and not more than $1,000,000 or to imprisonment for not more than two years, or to both a fine and imprisonment.
5 An inspector may exercise any power or authority provided under Part XII of the Environment Act, and has any immunities granted under that Part, in investigating any suspected offence under this Act.
