Explanatory Note

This Bill requires residential care facilities, homes for the disabled, homes for the aged and nursing homes to meet the standards for long-term care of the Health Standards Organization and requires the minister responsible for the Homes for Special Care Act to provide to non-profit residential care facilities, homes for the disabled, homes for the aged and nursing homes programming support in meeting those standards.

An Act to Amend Chapter 203
of the Revised Statutes, 1989,
the Homes for Special Care Act,
Respecting National Standards

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the National Standards in Long-term Care Act.

2 Chapter 203 of the Revised Statutes, 1989, the Homes for Special Care Act, is amended by adding immediately after Section 5 the following Section:

    5A (1) Notwithstanding Section 5 but subject to subsection (3), a residential care facility, home for the disabled, home for the aged or nursing home must demonstrate compliance with the standards for long-term care of the Health Standards Organization.

    (2) The Minister shall provide to non-profit residential care facilities, homes for the disabled, homes for the aged or nursing homes programming support in meeting the standards referred to in subsection (1).

    (3) A person holding a licence pursuant to Section 5 when this Section comes into force must prove compliance with subsection (1) within two years of this Section coming into force.
