Explanatory Note

This Bill requires

(a) facilities licensed under the Homes for Special Care Act to have air conditioning installed in all residents' rooms by June 1, 2023; and

(b) the Government to provide financial support to facilities for costs associated with the air conditioning installation.

An Act to Amend Chapter 203
of the Revised Statutes, 1989,
the Homes for Special Care Act,
Respecting Comfort in Long-term Care

Be it enacted by the Governor and Assembly as follows:

1 Chapter 203 of the Revised Statutes, 1989, the Homes for Special Care Act, is amended by adding immediately after Section 12 the following Section:

    12A (1) Subject to subsection (2), no later than June 1, 2023,

    (a) a licensee shall have air conditioning installed in the rooms of all residents at the licensee's residential care facility, home for the disabled, home for the aged or nursing home; and

    (b) the Government shall create a grant program to provide financial support to licensees for costs associated with the air conditioning installation.

    (2) The money required for the purpose of this Section must be paid out of money appropriated for that purpose by the Legislature.
