Explanatory Note

This Bill provides for free testing for coliform bacteria, arsenic, lead and uranium in well-water used as a source of drinking water.

An Act to Amend Chapter 1
of the Acts of 1994-95,
the Environment Act

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Free Well-water Testing Act.

2 Section 105 of Chapter 1 of the Acts of 1994-95, the Environment Act, as amended by Chapter 30 of the Acts of 2006 and Chapter 61 of the Acts of 2011, is further amended by adding immediately after subsection (4) the following subsections:

    (5) The Minister shall offer free testing of well-water used as a source of drinking water to detect the presence and level of

    (a) coliform bacteria;

    (b) arsenic;

    (c) lead; and

    (d) uranium.

    (6) Testing offered under subsection (5) must be offered

    (a) at least every six months for coliform bacteria; and

    (b) at least every two years for arsenic, lead and uranium.

3 The money required for the purpose of this Act must be paid out of money appropriated for that purpose by the Legislature.
