Explanatory Notes

Clause 1 creates a definition of "virtual care".

Clause 2 includes virtual care from a variety of service providers as insured professional services in the M.S.I. Plan.

Clause 3 allows the Governor in Council to make regulations respecting virtual care and prescribing additional providers of virtual care.

An Act to Amend Chapter 197
of the Revised Statutes, 1989,
the Health Services and Insurance Act,
Respecting Virtual Care

Be it enacted by the Governor and Assembly as follows:

1 Section 2 of Chapter 197 of the Revised Statutes, 1989, the Health Services and Insurance Act, as amended by Chapter 20 of the Acts of 1992 and Chapter 7 of the Acts of 2011, is further amended by

(a) striking out the period at the end of clause (n) and substituting a semi-colon; and

(b) adding immediately after clause (n) the following clause:

    (o) "virtual care" means health care that is provided via telephone or internet communication.

2 Chapter 197 is further amended by adding immediately after Section 3 the following Section:

    4 (1) Subject to the regulations and subsection (2), insured professional services include virtual care provided by

    (a) nurse practitioners;

    (b) specialist medical practitioners;

    (c) physiotherapists;

    (d) respiratory therapists;

    (e) occupational therapists;

    (f) registered nurses;

    (g) dieticians;

    (h) other prescribed persons.

    (2) The money required for the purpose of subsection (1) must be paid out of money appropriated for that purpose by the Legislature.

3 Subsection 17(2) of Chapter 197, as amended by Chapter 20 of the Acts of 1992, is further amended by adding immediately after clause (b) the following clauses:

    (ba) respecting virtual care;

    (bb) prescribing persons for the purpose of subsection 4(1);
