Explanatory Note

This Bill expands the definition of "resident" or "resident of the Province" in the Health Services and Insurance Act to include any person resident in Nova Scotia.

An Act to Amend Chapter 197
of the Revised Statutes, 1989,
the Health Services and Insurance Act,
to Expand M.S.I. Coverage

Be it enacted by the Governor and Assembly as follows:

1 Section 2 of Chapter 197 of the Revised Statutes, 1989, the Health Services and Insurance Act, as amended by Chapter 20 of the Acts of 1992 and Chapter 7 of the Acts of 2011, is further amended by repealing clause (l) and substituting the following clause:

    (l) "resident" or "resident of the Province" means any person resident in the Province and includes a person resident in the Province who

      (i) is a child born in the Province, regardless of the immigration status of the child's parents,

      (ii) has not been granted legal permission to reside in Canada by the Government of Canada or whose permission has expired,

      (iii) has entered Canada through the Temporary Foreign Worker Program administered by the Government of Canada, regardless of the current employment status of the person,

      (iv) is a student, regardless of the start or duration of the student's residency,

      (v) is an adopted child, even if born outside of Canada,

      (vi) is a child in the process of being adopted, even if born outside of Canada,

      (vii) has been granted refugee status by the Government of Canada but has not yet applied for permanent residency,

      (viii) is a person applying for permanent residency in Canada on humanitarian or compassionate grounds,

      (ix) is a dependent child or spouse of a person who has refugee status in Canada, or

      (x) is a person defined in the regulations.

2 Subsection 17(1) of Chapter 197, as amended by Chapter 20 of the Acts of 1992 and Chapter 7 of the Acts of 2011, is further amended by adding "further" immediately before "defining" in the first line of clause (e).

3 The money required for the purpose of this Act must be paid out of money appropriated for that purpose by the Legislature.
