Explanatory Note

This Bill imposes a requirement on the Highway 104 Western Alignment Corporation to pay and discharge all costs, liabilities and repairs in respect of the Western Alignment by September 7, 2020. It also prohibits tolls from being imposed or collected in respect of the Western Alignment once the Corporation has paid or discharged the costs and liabilities.

An Act to Amend Chapter 4
of the Acts of 1995,
the Highway 104 Western Alignment Act

Be it enacted by the Governor and Assembly as follows:

1 Subsection 13(2) of Chapter 4 of the Acts of 1995, the Highway 104 Western Alignment Act, is repealed and the following subsections substituted:

    (2) Notwithstanding any agreement to the contrary, the Corporation shall pay or otherwise discharge all costs and liabilities relating to the Western Alignment, including respecting its financing, design, construction, operation and maintenance and any repair, improvement, replacement, alteration or extension of the Western Alignment by September 7, 2020.

    (3) Tolls must cease to be imposed or collected in respect of the Western Alignment once the Corporation has paid or discharged the costs and liabilities in respect of the Western Alignment in accordance with subsection (2).
