Halifax Convention Centre Act

Explanatory Notes

Clause 1 updates the definitions of "Deputy Minister" and "Minister" in the Halifax Convention Centre Act to reflect the current name of the Department of Business.

Clause 2

(a) allows the Halifax Convention Centre Corporation to carry on business under the name Events East Group;

(b) increases the amount that may be spent by the Corporation without prior written approval of the Chief Administrative Officer and the Minister of Business; and

(c) removes the requirement for the Corporation to seek the approval of the Halifax Regional Municipality Council and the Minister of Business to hire, remunerate or remove its vice-president.

Clause 3 removes a requirement for the Corporation to provide an annual report on the effectiveness and competitiveness of the operations of the Convention Centre.

Clause 4 changes the timing of the strategic plan of the Corporation from a date established by the regulations to as required by the Council and the Minister and removes a requirement to include estimates of budgetary requirements.

Clause 5 changes the timing of the business plan from a date established by the regulations to annually as required by the Council and the Minister and removes a requirement for the business plan to include an outline of aspects of the Convention Centre's operations to be performed by external parties.

Clause 6 changes the timing of the independent evaluation and five-year strategic plan from a date established by the regulations to as required by the Council and the Minister.

Clause 7 requires the Corporation to enter into annual outcome agreements as requested by the Council and the Minister.

An Act to Amend Chapter 8
of the Acts of 2014,
the Halifax Convention Centre Act

Be it enacted by the Governor and Assembly as follows:

1 Section 2 of Chapter 8 of the Acts of 2014, the Halifax Convention Centre Act, is amended by

(a) striking out "Economic and Rural Development and Tourism" in the first and second lines of clause (h) and substituting "Business"; and

(b) striking out "Economic and Rural Development and Tourism" in the first and second lines of clause (k) and substituting "Business".

2 (1) Subsection 21(1) of Chapter 8 is amended by adding immediately after clause (f) the following clause:

    (fa) carry on business under the name Events East Group;

(2) Subsection 21(2) of Chapter 8 is repealed and the following subsection substituted:

    (2) An agreement or contract that will result in an expenditure exceeding $500,000, excluding applicable consumption taxes, requires the prior written approval of the Chief Administrative Officer and the Minister.

(3) Clause 21(4)(g) of Chapter 8 is amended by striking out ", a vice-president" in the second line.

3 Subsection 27(2) of Chapter 8 is repealed.

4 Section 28 of Chapter 8 is amended by

(a) striking out "On or before a date to be established by the regulations and every five years thereafter" in the first and second lines and substituting "As required by the Council and the Minister"; and

(b) striking out ", including estimates of budgetary requirements," in the third line.

5 (1) Subsection 29(1) of Chapter 8 is amended by striking out "On or before a date to be established by the regulations and annually thereafter" in the first and second lines and substituting "Annually, as required by the Council and the Minister".

(2) Subsections 29(2) and (3) are repealed.

6 Subsection 30(1) of Chapter 8 is amended by striking out "On or before a date to be established by the regulations," in the first line and substituting "As required by the Council and the Minister".

7 Chapter 8 is further amended by adding immediately after Section 30 the following Section:

    30A The Corporation shall enter into annual outcome agreements as requested by the Council and the Minister.
