Explanatory Note

This Bill expands the jurisdiction of the Ombudsman to receive and investigate complaints regarding the administration of nursing homes and residential care facilities.

An Act to Amend Chapter 327
of the Revised Statutes, 1989,
the Ombudsman Act

Be it enacted by the Governor and Assembly as follows:

1 Section 2 of Chapter 327 of the Revised Statutes, 1989, the Ombudsman Act, as amended by Chapter 6 of the Acts of 2004 and Schedule A of Chapter 1 of the Acts of 2018, is further amended by

(a) striking out "and" in the fourth line of clause (b) and substituting a comma;

(b) adding "and the person in charge of a nursing home or a residential care facility as defined in the Homes for Special Care Act" immediately after "agency" in the last line of clause (b);

(c) striking out clause (c) and substituting the following clause:

    (c) "department" means

      (i) a department of the Government of the Province,

      (ii) a nursing home or a residential home as defined in the Homes for Special Care Act, or

      (iii) an agency;

(d) adding "a nursing home or a residential care facility as defined in the Homes for Special Care Act, or" immediately after "for" in the third line of clause (e);

(e) striking out "or" in the first line of clause (h) and substituting a comma; and

(f) adding "or the person in charge of a nursing home or a residential care facility as defined in the Homes for Special Care Act" immediately after "unit" in the last line of clause (h).
