Explanatory Note

This Bill prohibits the sale of flavoured tobacco effective May 31, 2015. It does not prohibit flavoured electronic cigarettes and e-liquids.

An Act to Amend Chapter 14
of the Acts of 1993,
the Tobacco Access Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Section 3 of Chapter 14 of the Acts of 1993, the Tobacco Access Act, as amended by Chapter 12 of the Acts of 1999, is further amended by adding immediately after clause (b) the following clause:

(ba) "flavoured tobacco" means tobacco that

(i) has a characterizing flavour,

(ii) is represented as being flavoured, or

(iii) is designated by the regulations as being flavoured;

(2) Where Bill 60, introduced during the Second Session of the 62nd General Assembly and entitled An Act to Amend Chapter 12 of the Acts of 2002, the Smoke-free Places Act, and Chapter 14 of the Acts of 1993, the Tobacco Access Act, receives Royal Assent, clause 3(ba) of Chapter 14, as enacted by subsection (1), is amended by

(a) striking out the semicolon at the end of subclause (iii) and substituting a comma; and

(b) adding "but does not include electronic cigarettes;" immediately after subclause (iii).

2 Section 7 of Chapter 14, as amended by Chapter 12 of the Acts of 1999, is further amended by

(a) striking out "or" at the end of clause (a);

(b) striking out the period at the end of clause (b) and substituting "; or"; and

(c) adding the following clause:

(c) flavoured tobacco.

3 This Act has effect on and after May 31, 2015.
