Explanatory Note

This Bill changes the name of the University College of Cape Breton to Cape Breton University and, consequentially, changes the name of the College of Cape Breton Foundation and the University College of Cape Breton Student Union.

An Act to Change the Name of the
University College of Cape Breton
and to Amend Chapter 484
of the Revised Statutes, 1989,
the University College of Cape Breton Act,
and Related Statutes

Be it enacted by the Governor and Assembly as follows:

1 The name of the University College of Cape Breton, established by Chapter 484 of the Revised Statutes, 1989, the University College of Cape Breton Act, is changed to "Cape Breton University".

2 The title of Chapter 484 is amended by striking out "the University College of Cape Breton" and substituting "Cape Breton University".

3 Section 1 of Chapter 484 is amended by striking out "University College of Cape Breton" in the first and second lines and substituting "Cape Breton University".

4 Clause 2(f) of Chapter 484 is repealed and the following clause substituted:

(f) "University" means Cape Breton University.

5 (1) Subsection 3(1) of Chapter 484 is amended by striking out "The University College of Cape Breton" in the first line and substituting "Cape Breton University".

(2) Subsection 3(3) of Chapter 484 is amended by striking out "managenent" in the first line and substituting "management".

6 Section 4 of Chapter 484 is amended by striking out "College" in the sixth line.

7 Chapter 484 is further amended by striking out "College" wherever it appears except in the title, Section 1, clause 2(f), subsection 3(1) and Section 4.

8 A reference in any enactment or document to the University College of Cape Breton is, as regards any subsequent transaction, matter or thing, deemed to be a reference to Cape Breton University.

9 No rights, duties, obligations or liabilities of the University College of Cape Breton or its Board of Governors are in any way affected by the change of name made by this Act and those rights, duties, obligations and liabilities continue to be vested in and are binding upon them under the name "Cape Breton University".

10 The name of the University College of Cape Breton Foundation, established by Chapter 114 of the Acts of 1962, An Act Respecting the University College of Cape Breton Foundation, is changed to "Cape Breton University Foundation".

11 The title of Chapter 114, as amended by Chapter 90 of the Acts of 1976 and Chapter 59 of the Acts of 1982, is further amended by striking out "University College of Cape Breton" and substituting "Cape Breton University".

12 Section 1 of Chapter 114, as enacted by Chapter 90 and amended by Chapter 59, is further amended by

(a) striking out "is" in the third line and substituting "and"; and

(b) adding "is continued under the name of the " Cape Breton University Foundation" immediately before the period in the last line.

13 Section 2 of Chapter 114, as enacted by Chapter 90 and amended by Chapter 59, is further amended by striking out "the University College of Cape Breton" in the last line of clause (a), in the last two lines of clause (b) and in the last two lines of clause (c) and substituting in each case " Cape Breton University".

14 A reference in any enactment or document to the University College of Cape Breton Foundation is, as regards any subsequent transaction, matter or thing, deemed to be a reference to the Cape Breton University Foundation.

15 No rights, duties, obligations or liabilities of the University College of Cape Breton Foundation are in any way affected by the change of name made by this Act and those rights, duties, obligations and liabilities continue to be vested in and are binding upon it under the name "Cape Breton University Foundation".

16 The name of the University College of Cape Breton Student Union, established by Chapter 40 of the Acts of 2000, the University College of Cape Breton Student Union Act, is changed to "Cape Breton University Student Union".

17 The title of Chapter 40 is amended by striking out "University College of Cape Breton" and substituting "Cape Breton University"

18 Section 1 of Chapter 40 is amended by striking out "University College of Cape Breton" in the first and second lines and substituting "Cape Breton University".

19 Clause 2(d) of Chapter 40 is amended by striking out "University College of Cape Breton" in the first and second lines and substituting " Cape Breton University".

20 Section 3 of Chapter 40 is amended by striking out "University College of Cape Breton" in the second line and substituting " Cape Breton University".

21 Section 5 of Chapter 40 is amended by striking out "the University College of Cape Breton" in the last line of clause (b) and in the last two lines of clause (c) and substituting in each case " Cape Breton University".

22 A reference in any enactment or document to the University College of Cape Breton Student Union is, as regards any subsequent transaction, matter or thing, deemed to be a reference to the Cape Breton University Student Union.

23 No rights, duties, obligations or liabilities of the University College of Cape Breton Student Union are in any way affected by the change of name made by this Act and those rights, duties, obligations or liabilities continue to be vested in and are binding upon it under the name "Cape Breton University Student Union".

24 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
